1. General Terms and Conditions
These General Terms and Conditions shall apply to any commercial relationship established between Masina-Tuote Oy (hereinafter “Masina-Tuote”) and its customer (hereinafter “Customer”) when the Customer orders a product from the Masina-Tuote Online Shop. The orders placed by the Customer shall be governed by the terms and conditions valid at the time the order was placed, as disclosed on the online shop website. However, any changes in legislation shall apply as such with immediate effect unless otherwise provided by law.
Upon placing an order, the Customer accepts these General Terms and Conditions of Masina-Tuote Online Shop as they stand.
The Customer may be a consumer customer (hereinafter “Consumer”) or a corporate customer (hereinafter “Corporate Customer”). A Customer who purchases products for the purpose of pursuing business or trade shall be considered a Corporate Customer. These General Terms and Conditions only apply to a Consumer insofar as they are not at variance with the mandatory laws pertaining to consumer protection.
Masina-Tuote only sells its products to a Customer of legal age.
Upon placing an order, the Customer is required to provide his or her full contact details, including, at the minimum, his or her name, address, telephone number and e-mail address, if any. Corporate Customers are also required to provide their business identity code.
3. Creation and Binding Effect of an Agreement
A purchase agreement with binding effect is created between the Customer and Masina-Tuote as soon as the Customer’s order is recorded in Masina-Tuote’s system. A precondition for having the order successfully recorded in the system is that the payment method for the order has been accepted. In the event that the ordered product is not available in Masina-Tuote’s stock, the Customer will be notified of the estimated time of delivery, on which occasion the Customer may unconditionally cancel his or her order. If the Customer chooses not to cancel his or her order, the order will be recorded in Masina-Tuote’s system as a binding order
When the order has been successfully recorded, the Online Shop will send an order confirmation to the e-mail address indicated by the Customer.
Masina-Tuote shall not be liable for any loss or damage due to force majeure circumstances. Force majeure circumstances refer to an unforeseen circumstance or change of circumstances that affects the execution of the delivery and is beyond Masina-Tuote’s control.
4. Products and Price List
The prices stated in the price list of Masina-Tuote Online Shop are exclusive of value added tax and delivery charges. If the Customer makes any changes to the order, the price shall be determined according to the then-current price of the product.
Masina-Tuote reserves the right to restrict the sale of products in exceptionally large quantities, because the Online Shop is not primarily intended to serve the needs of actual retailers.
Import duties and tariffs- if any- are not included.
5. Methods of Payment
Payments may be made by Visa, Visa Electron or MasterCard and as a prepayment to the seller’s account.
The payment transfer service is carried out with Paypal serving as the payment transfer service provider in collaboration with Finnish banks and credit institutions. In payments made with Visa, Visa Electron or MasterCard, the payment recipient shown on the credit card invoice is Paypal, who transfers the payment to the seller. Paypal is a licensed payment institution.
6. Product Deliveries
Masina-Tuote delivers the products ordered from the Online Shop to the delivery address indicated by the Customer by post. Postal and other shipping costs shall be charged to the Customer when the Customer pays the purchase price of the product.
The average order processing time is 2 to 5 business days from the time when the Customer logged in to Masina-Tuote’s system. The shipping time is usually 1 to 2 business days. The shipping time may be longer for deliveries abroad.
The Customer is liable to check the received Masina-Tuote product within 7 days of its receipt and to file a complaint for any defects observed in the consignment.
With due consideration taken of the intended use of the product, the Customer is liable to carefully examine the instructions for use of the product before placing it in service.
7. Consumer’s Special Right to Withdraw from the Contract
The Consumer enjoys a special right to withdraw from the contract pertaining to any product purchased from the Masina-Tuote Online Shop within 14 days of the date when the product was received. In the event that the Consumer exercises his or her statutory right to withdraw from the purchase, Masina-Tuote will return the price paid for the product by the Consumer, including postal charges, when the Customer has returned the product to Masina-Tuote in an undamaged condition. The provisions of Chapter 6 of the Consumer Protection Act concerning distance selling shall also be complied with in other regards. However, no money-back guarantee and/or right of withdrawal is granted for the product if it has been modified according to the Customer’s specifications to suit the Customer’s special needs.
For the avoidance of doubt, it is noted that a Customer who operates as a trader does not enjoy the aforementioned right of withdrawal.
8. Return consignments
Any return consignments of Masina-Tuote products as well as warranty deliveries of products must always be sent by post. Parcels must be used as the form of delivery, because no consignment tracking is available for letters.
The Customer is required to retain the necessary copies of the return documents. The parcel tracking code received from Posti’s customer returns service is the only means available for proving that the item concerned has been sent.
The Customer must contact Masina-Tuote (email@example.com) prior to making any warranty-related return based on an alleged defect in the product.
The responsibility for properly packaging the item always rests with the consignor. The Customer is also required to carefully package the product being returned and to properly protect it against damage during transport.
Masina-Tuote accepts no liability for any damage incurred to returned items that have been packed carelessly and in contravention of the terms of contract. Any costs attributable to a fault on the Customer’s side shall be charged to the customer.
Masina-Tuote reserves the right to charge the costs to the Customer in the event that the customer return was carried out without due cause or in contravention of the terms of contract.
9. Warranty and Liability for Lack of Conformity
Masina-Tuote grants a warranty for the products purchased from the Online Shop subject to the terms and conditions specified below. The warranty granted for the products covers the defects in the workmanship and materials of the Masina-Tuote product delivered to the Customer. The warranty is valid for 1 year from the date of receipt of the product.
In the event that a defect or shortcoming covered by the warranty is observed in the Masina-Tuote product, the Customer must promptly notify Masina-Tuote thereof in writing. The warranty only applies to defects or shortcomings in the product in respect of which a notice of defect has been duly filed within the warranty period. The Customer shall forfeit his or her right to invoke a defect or shortcoming in the product if no written notice of defect is filed within the aforementioned period.
